RETENTION OF ENVIRONMENTAL ATTRIBUTES. Unless otherwise agreed to in writing by Seller, Seller retains all rights and interests, free and clean of any claims, liens, and encumbrances in favor of Buyer, in and to all environmental attributes that may be associated with the products sold under this Agreement (which attributes include, among other things, all characteristics that enable the energy that such products produce, consume, or avoid consuming to qualify for incentives and payments, other than with respect to ratepayer-funded incentive programs offered by or on behalf of an electric or natural gas utility).
